Terms and Conditions – The Epicurean

GENERAL TERMS AND CONDITIONS OF SALE

These general terms and conditions of sale apply to all products and items offered by L'Épicurien , whether offered in the context of auctions (the "lots") or through L'Épicurien's online store (collectively, the "items"), as they may be modified by a notice, an auction house announcement or a website update.

The items are offered for sale by L'Épicurien on their own behalf.

These general terms and conditions of sale constitute the entire agreement applicable to all sales of items by L'Épicurien. Any purchaser of alcoholic beverages, whether through an auction or the online store, must be eighteen (18) years of age or older, in accordance with the laws of Quebec. Proof of age may be required before the transfer of any purchased item, including, but not limited to, the presentation of photo identification.


WINE CONDITION

Items, including lots sold at auction and products sold via the online store, are sold "as is", without recourse, unless expressly stated otherwise.

Neither L'Épicurien nor the auctioneer provides any warranty whatsoever regarding the items. They cannot be held liable for errors in description or defects. All implied warranties and conditions provided by law are excluded to the fullest extent permitted by law.

It is the buyer's responsibility to inspect the items and ensure their condition as described and presented on the website or, where applicable, during the pre-auction exhibition.


REGISTRATION (AUCTIONS ONLY)

Registration is required only to participate in auctions .
Buyers wishing to bid must be registered and may be subject to credit card verification. An amount of approximately $1.00 may be charged to the card and then refunded to validate its legitimacy.
No such charges are made for purchases made through the online store.


AUCTIONS (IF APPLICABLE)

When the sale is conducted by auction, it takes place by lot number, as indicated in the catalog or on the website. Lots are sold as described. The auctioneer may withdraw, combine, or divide lots at their discretion.
The lots sold are subject to a commission of 17.5% plus taxes.


SALE

Sales are conducted through L'Épicurien vins d'exception, acting as agent for the Société des alcools du Québec, both for auctions and for sales made via the online store.


PAYMENT

All items purchased, whether at auction or through the online store, must be paid for in full according to the terms indicated at the time of the transaction. No delivery or collection will be made until full payment has been received.


PICKUP AND DELIVERY

Unless otherwise agreed, items must be collected within the time frame indicated at the time of purchase or, in the case of an auction, no later than five (5) business days following the conclusion of the sale. Delivery charges, where applicable, are the responsibility of the buyer.

All items purchased, whether at auction or through the online store, must be paid in full in accordance with the payment terms indicated at the time of purchase. No delivery or release of items will occur until full payment has been received.


PICKUP AND DELIVERY

Unless otherwise agreed in advance, items must be picked up within the timeframe specified at purchase or, in the case of an auction sale, no later than five (5) business days following the conclusion of the sale. Delivery, when requested, is at the buyer's expense.
